Using online services

Manner of use

You may use information provided to you through Council’s online services, solely for your personal and/or internal business purposes. You must not remove any proprietary rights notices, modify the information, or make it available to any third parties.

Legal capacity to contract

In using Council’s online services, you declare that you are over 18 years of age and have legal capacity to contract in Australia. If you are using a credit card to process a transaction, you declare that the credit card is issued in your name and that you will pay to the issuer all charges incurred using Council’s online services.

Transaction information

The accuracy, currency, completeness or otherwise of any information you provide to Council in the course of using any services is your responsibility and you agree to be bound by it.  Council is not responsible for ensuring that any information provided by you in the course of using any service is accurate, current or complete.

Verified access

Certain online services offered by Council require verified access (for example, a login ID and password).  You agree that you are solely responsible for:

  • only providing information to Council that is accurate, current and complete
  • maintaining the security of your login and password, and
  • all activity which occurs on or through your account, whether authorised or unauthorised.

You should change your password immediately if you believe that your login or password has been used without authorisation. Council accepts no liability for your failure to comply with these obligations.

Specific service terms and conditions

You acknowledge that any online services made available by Council may be subject to specific additional terms and conditions, and you agree to review and comply with those terms and conditions.  Access to and use of any of Council’s online services shall be deemed to constitute acceptance of the additional terms and conditions applicable to such services.

Mapping Services

Council provides access via this website to certain of its mapping records.  Access to the records is provided in good faith and for general information purposes only.  You agree to seek independent expert advice before relying on any information contained in any mapping records accessed via this website.

Security

Online services are provided through a secure website [using SSL (secure socket layer) encryption or TLS (transport layer security)].  However, you acknowledge that internet transmissions are never entirely secure or private, and that any message or information you send to or through the website (including credit card information) may be read or intercepted by others, even where a website is stated to be secure.

Age of user

If you are aged 16 or under, you need your parent’s or guardian's permission before you provide personal information to Council through our website. Users without parental or guardian consent are not allowed to provide Council with personal information.

The staff who maintain and operate the City website are subject to the Privacy and Personal Information Protection Act 1998 and Council’s Privacy Management Plan PDF, 374.46 KB.

Collecting your information

You authorise Council to collect information about you and about the transactions processed by you via Council’s online services.  Council may also make use of website data that directly or indirectly identifies users.

Site visit data

This site uses Google Analytics to track visitor data and behaviour in an anonymous form.

Confidentiality

You may request that certain documents provided to Council be treated as confidential. However, the final discretion lies with Council.

Dealing with your information

Council will deal with any such information that is personal information in accordance with its Privacy Management Plan PDF, 374.46 KB, the Privacy Code of Practice for Local Government, and the Privacy and Personal Information Protection Act 1998.

Releasing your information

You authorise Council to release any of your information to any third party if:

  • the third party is used by Council in order to provide services to you
  • Council is requested to do so in the course of a criminal or other legal investigation
  • Council determines that disclosure is necessary in connection with any complaint regarding your use of the website or services.

Council will not be liable under any circumstances for any loss of profits, direct or indirect loss, damage or injury (even if it has been advised of the possibility of such loss of profits or damages) which are the consequence of you acting, or failing to act, on any information contained on or referred to on this website, or any information provided to you through any service on the website.

Council is not liable to you for defamatory, offensive or illegal conduct of any user of this website, whether caused through negligence of Council or through any other cause.

Online Services

Council does not warrant, guarantee or make any representation, express or implied, that:

  • any services will be available at any time for use by you;
  • this website, or the server that makes the site available on the WWW, is free of software viruses;
  • the functions contained in any software contained on this website will operate uninterrupted or are error-free; and
  • errors and defects in this website will be corrected.

Council may, at any time, without prior notice, and without incurring any liability, to you, cancel or suspend any or all online services and/or substitute alternative services, which may or may not be interactive or transactional in nature.

Council will not be liable under any circumstances for any loss or any damages of any kind which are the consequence of the unavailability of any service for your use or your inability to use any service.

Transaction information

Council is not liable for any loss or damages suffered by you or any third party where the loss or damages are a result of you providing information to Council that is inaccurate, outdated or incomplete.

Verified access

Council accepts no liability for your failure to comply with the obligations listed under the sub-heading ‘Verified access’ in the Online Services section above.

Security

Council accepts no liability for the interception or ‘hacking' of data through the website by unauthorised third parties.

Privacy

Council disclaims any and all warranties, express or implied, regarding the handling of any of your information, including personal information, by any third party in the manner required by Australian law or otherwise.
